Regulations of the Agricultural and Food Market 'Targpiast' Wrocław, Obornicka Street 235-237

1. The market is managed by "Targpiast" Sp. z o.o., 51-114 Wrocław, Obornicka Street 235-237, tel.: 71 325 40 67, 71 712 59 00, fax: 71 325 21 45.

2. The market operates 24/7. Periodically, the market manager may establish different opening and closing hours of market operation.

3.1 The market hosts wholesale trade of agricultural, food, and industrial products, and the sale of items not excluded from circulation by separate regulations is allowed, except for:

  • a) weapons, ammunition, pyrotechnic materials, and explosives,
  • b) diesel fuel, gasoline, medicinal substances,
  • c) items harmful to health or posing a threat to human life and lacking required markings and certificates,
  • d) other items, the sale of which is permanently or temporarily prohibited by separate regulations.

3.2 With the manager's approval, non-commercial and service activities may be conducted in the market.

4. The following prohibitions apply in the market:

  • a) sale and consumption of alcoholic beverages, except for points with appropriate permits,
  • b) open flame usage and the use of gas heating devices without supervision,
  • c) import and leaving of garbage, waste, impurities, etc.,
  • d) conducting commercial activities in places not designated for it,
  • e) washing of motor vehicles.

5.1 Individuals conducting commercial, service, or other activities, as well as other market users, are obliged to strictly adhere to the market regulations, sanitary, order, fire regulations, and market service instructions.

5.2 The acquisition of a ticket/pass implies a declaration by the holder that they have acquainted themselves with the content of the market regulations. Individuals conducting commercial, service, and other activities based on individual lease agreements, as well as other market participants, have the right to enter and stay in the market after acquainting themselves with and accepting the provisions of the market regulations.

6. Individuals not adhering to the provisions mentioned in point 5.1 may be:

  • a) prohibited from selling and consuming alcoholic beverages except for points with appropriate permits,
  • b) fined by authorized authorities such as the Police, Municipal Guard, Fire Brigade, Sanitary Inspection,
  • c) subject to a ban on entering the market area.

7. Individuals who, while on the market premises, behave in a manner that is inconvenient for other market users, violates generally accepted principles of social coexistence, or poses a threat to the property and personal dignity of others, upon the request of the market manager or Plaza Security Service, are required to leave the market area. For this purpose, the market manager, on their initiative or at the request of other individuals, including market users, may issue instructions to the Plaza Security Service or other authorized entities to remove such individuals from the market area or prohibit them from entering the market or the facilities within it.

8. Individuals conducting commercial, service, and other activities in the market, under the risk of losing the right to continue such activities, terminating the lease agreement, or being removed from the market – in the case of individuals conducting commercial activities based on one-time tickets – are obliged to:

  • a) maintain order and cleanliness within the sales/activity area,
  • b) tidy up the sales/activity area after its completion,
  • c) dispose of waste in accordance with the relevant regulations,
  • d) conduct activities only in places designated by the staff or market manager,
  • e) pay rent and other fees on time.

9. The sales location is designated by the staff or market manager. The sales location must not be:

  • a) designated on roads, sidewalks, traffic or unloading lanes, in a way that obstructs and hinders traffic,
  • b) relinquished by commercial operators to whom the location has been designated.

10. The sale of fruits and vegetables not of domestic production is carried out exclusively from designated commercial boxes and designated market stalls in permanent market facilities. Trade in these items outside the designated locations is prohibited.

11. The sale of goods that are reasonably suspected to be harmful to health, originating from theft, or other illegal sources of acquisition, will be suspended by the market manager or staff, who will report such cases of violation to the relevant authorities.

12. In particularly justified cases, such as industry reorganization, orders from relevant public authorities, renovations, as well as other important reasons, the market manager reserves the right to reduce the leased space, move the stall to another location, temporarily suspend commercial activities without terminating the agreement, or terminate the agreement allowing for market activities.

13.1 Entry to the market area is subject to a fee.

13.2 Entry to the market area for entities selling goods is subject to an exploitation fee.

  • a) the amount of the exploitation fee is determined by the price list adopted by the market manager,
  • b) the ticket seller is obliged to issue payment tickets, as mentioned in point a), containing the vehicle registration number, date, and entry time,
  • c) purchased tickets must be kept for inspection and presented to authorized persons upon their request,
  • d) failure to have valid tickets obliges commercial operators to purchase them, with the obligation to make the necessary payments starting from the expiration of the validity of the tickets,
  • e) sellers operating from vehicles staying on the market for more than 24 hours are obliged to keep payment tickets for the entire period of their stay on the market and present them for inspection upon the request of authorized persons,
  • f) failure to present valid tickets for inspection to persons mentioned in point c), avoiding payment, or the absence of any tickets entitling to conduct commercial activities on the market premises, in addition to fulfilling the requirement specified in point d), obliges the individual to pay an additional fee, three times the daily rate specified in the price list mentioned in point a).

13.3 Entry to the market area by vehicles transporting agricultural produce for other entities operating in the market is subject to a fee determined by the price list mentioned in point 13.2 a). The provisions of point 16.1 of the regulations apply accordingly to these entities.

14. Entry to the market area for entities purchasing goods is based on an entry ticket:

  • a) the amount of the fee is determined by the price list mentioned in point 13.2 a),
  • b) the ticket seller is obliged to issue an entry ticket as mentioned in point a), containing the vehicle registration number, date, and entry time,
  • c) the purchased ticket must be kept for inspection and presented to authorized persons upon their request,
  • d) the absence of a current entry ticket obliges the individual to purchase one,
  • e) the lack of a current entry ticket, failure to show the entry ticket for inspection to persons mentioned in point c), avoiding payment, entails, in addition to fulfilling the requirement specified in point d), the obligation to pay an additional fee determined by the market manager.

15. Entry to the market area for privileged entities, not making purchases – other than those specified in point 13.3 and 16.1, engaged in activities other than trade, as well as owners or lessees of commercial stalls and their employees, is carried out as specified by the market manager.

16.1 Entry to the market area by vehicles transporting goods, other than those specified in point 13.3, for entities operating in the market is allowed for vehicles whose users present an invoice or pro forma invoice for the imported goods upon entry. The following conditions apply:

  • a) unloading of delivered goods takes place within a specified time limit determined by the market manager,
  • b) after delivering the goods to the sales point, confirming the receipt of the goods on the ticket/pass, the vehicle must promptly leave the market area,
  • c) deliveries of goods by heavy-tonnage vehicles (such as TIR) take place only in designated locations and at designated times,
  • d) in case of non-confirmation of the receipt of the goods on the ticket/pass or leaving vehicles on the market premises after delivering the goods to the commercial stalls, they will be considered, according to the regulations, as mobile sales points. Charges will be collected for the period of leaving these vehicles on the market,
  • e) in case of failure to pay fees by the vehicle users mentioned in point c), responsible for settling the fees for the period of leaving the vehicle on the market will be the lessees or owners of commercial stalls to which the goods were delivered from the mentioned vehicles.

16.2 The amount of fees specified in point 16.1 is governed by the price list mentioned in point 13.2 a).

17. In justified cases, the market manager may temporarily waive the collection of entry fees for specific entities.

18. Natural persons, legal entities, and organizational units without legal personality engaged in sales on the market premises may be subject to fees related to this activity based on separate regulations.

19. Only the market manager is authorized to collect fees on the market premises. Fee collection is carried out by market manager employees and individuals authorized by them.

20.1 Vehicles on the market premises without permission for entry, current fees, and in a manner blatantly violating market regulations may be immobilized using a wheel blocking device.

20.2 Vehicles and sales points left on the market premises without current fees or unlawfully will be treated as abandoned and may be removed from the market premises at the owner's expense. Spółka "Targpiast" sp. z o.o. is not responsible for any damages or property left behind.

21.1 Any disputes between market users and ticket and order services are resolved by the market manager or Plaza Security Service.

21.2 For all commercial transactions concluded on the market premises, sellers and buyers are responsible in accordance with the civil code and other applicable regulations.

21.3 The market management company Targpiast sp. z o.o. is not liable for property damage to users and market participants resulting from theft, spoilage of goods, fire, flooding, and other random events, nor is it responsible for damages related to vehicle traffic, unless they result from wrongful actions of market manager employees, and for damages related to interruptions in the supply of electricity, water supply, and sewage disposal.

22. Placing any advertisements on the market premises requires the prior written consent of the market manager.

23. Matters not regulated by the provisions of this regulation are subject to the appropriate orders and resolutions of the market manager.

24. Traffic rules apply on the market premises.

25. The regulations come into force on the day of adoption.
